Chapter 9
Brandi was feeling almost 100% again and honestly, was suffering from a mild case of “cabin fever” and needed to get out of the apartment. It was Friday and she was scheduled to return to work the following Tuesday. She spent most of her days reading, with Crunchy on her lap, or making dinner for when Lupe returned from work. She was still reluctant to go out alone, because sometimes, when she closed her eyes, she could still see the car that had hit her, speeding through the red light.
Yesterday, she had a second meeting with Joe Foss, the lawyer that Father Xavier had suggested to her. He was a charming fellow, and his wife, Keri, was sweet with her concerns for Brandi. In fact, she even made it a point to come pick her up at the apartment, because Lupe needed the car.
“Let’s review the facts,” Joe had stated. “He ran the light. There are multiple witness’ and even video footage. The light was in your favor. Traffic had started to move and you were in the marked bicycle lane. I’m actually astounded that you didn’t end up with multiple broken bones and internal injuries. The way you launched across the hood, bounced off the windshield, smashing it, by the way, and rolling to the pavement, it’s nothing short of a miracle that you’re not still in the hospital.”
“Several people told me that God was watching over me that day. I’m inclined to agree.”
“Here is my initial demand to the insurance company. All medical bills will be covered, including any follow up visits related to possible issues for up to ten years. Financial replacement for your bicycle. Yes, I know it was second hand, but we want replacement cost of the bike, not cash value. This will allow you to get something nicer than what you had.”
“Does Schwinn make anything with a full roll cage and multiple air bags? Because if my dad has any say in this, he will want me in some sort of armored vehicle, even if it is powered by me pedaling it.”
Keri burst out laughing at the comment. She did admire Brandi’s fortitude.
“I’m sure we can research that, if you wish. Furthermore...”
Joe presented a list of financial concerns and demands that included: Pain and Suffering, Emotional Trauma, Loss of Wages and things that Brandi had trouble keeping up with. When he was finished, he said; “I believe the total will be just under $920 thousand.”
“You can’t be serious!” Brandi sat, slack jawed. “I know he was at fault, but it was an accident! We can’t financially obliterate him for this! I couldn’t live with myself!”
“^That is just the initial starting point,” Joe smiled. “Offer, counter-offer. Back and forth unto we reach a realistic compromise. What is the least you will settle for?”
“Honestly? I can’t say. I have never been in a situation like this. I guess medical follow ups, a new bike and some cash? Not like a million bucks, but, something? Would it be okay if I just left it to your best judgment?”
“Certainly. But I plan to include my fees to be paid for by his insurance company.”
