IMHO that is reasonably easy.
If the chair is one of those wooden ones with a simple back then you are on it but if it is well upholstered and deep then you are in it because the arms are all embracing.
As for the lap the same rule applies - you are on it.

Both are correct. Regional differences. Write for the region the story is located in if you want to be precise.
