That's just 127 books chosen by the plaintiff. It's the principle that "scanning a book you purchased is a copyright violation" I would oppose. It should be covered by either fair use or first sale doctrine. That was after all allowed for CD to mp3 conversion.

Distributing that scanned copy to other people is not covered by either fair use or the first sale doctrine.
Nothing on the Internet Archive is someone's personal copy, they were all cases of someone distributing copies.
