Is it still incest?

tossing around an idea for a story.
uncle bob deals with his twin nieces who are not blood relations to him.
they are in fact his sister's wife's via the latter's brother's lover.
So the sister (Bob's) is gay but has an obsession with her brother's cock, not because it's a cock but because it's her brother's. the wife is Bi. the other males don't really feature in the story other than as an explanation of the story so far.

Thoughts?

Ok. Let's see.

Bob's sister's lesbian lover got knocked up by her own brother, and had twin daughters, who Bob (in true Lubrican fashion) knocked up, and somewhere along the way Bob's lesbian sister becomes obsessed with little Bob (even though as a lesbian she should have zero interest in such things).

Well, I suppose it makes sense... if they're from West Virginia, Saskatchewan, or the Gaspe.

No. the Wife was knocked up by her Brother's partner. initially as the first half of a deal, but the second half is not finalised as that relationship ends before it can happen.

Bob meets her after she gets pregnant and is responsible for introducing his sister to her future wife.

All I can say is I've know people with more 'complicated' histories. not everyone is a simple nuclear family. A very high % of my friends are what you might call alternative

Alternatives family's are fine, as are complicated families and histories. The key, though, is that they typically lead to discussions, where the characters managed to convey their feelings on the subject matter. The issue, if there even is one, is that skipping over a difficult subject, or avoiding an issue entirely, is often a red-flag in stories, any many times will trip up select groups of readers.

But, the author knows his story, and what works and what doesn't, so I won't belabor the point.

Thoughts?

Bob has a sister (Betty). Betty has a lesbian wife (Joan). Joan is thus Bob's sister-in-law.
Joan is Bi, Betty is lesbian, has fetish for Bob's cock.
Joan has two children (Molly and Polly).

Bob deals with Molly and Polly - so is this incest, presuming Molly and Polly are old enough.

Has Betty adopted Molly and Polly as her own children? Or, and this is where it gets odd from a legal, versus a societal perspective - did Joan get pregnant (from Joan's brother, John) before or AFTER she and Betty married?

If Betty married Joan, with Molly and Polly already around as babies or little kids, and did NOT adopt them, then they are step-nieces.

If Betty married Joan, with Molly and Polly already around as babies or little kids, and DID adopt them, then they are nieces.

If Betty married Joan, and THEN Molly and Polly came into being, then they are nieces.

Now, pick your state of residence.

Maine - Persons known to be within the 2nd degree of consanguinity

Maryland - Persons who may not marry, within 3 degrees of lineal consanguinity or 1 degree of collateral consanguinity

Arkansas - The person committing the act being at least 16 years of age, knowingly, and without regard to legitimacy, including blood relationships:
An ancestor or a descendant;
A stepchild or adopted child;
A brother or sister of the whole or half blood;
An uncle, aunt, nephew, or niece; or
A stepgrandchild or adopted grandchild.

Pennsylvania - Ancestor or descendant, a brother or sister of whole or half-blood, or an uncle, aunt, nephew, or niece of whole blood (blood relationships without regard to legitimacy, and relationship of parent and child by adoption).

Texas - Person known to be ancestor or descendant by blood or adoption; current or former stepchild or stepparent; parent's brother or sister of the whole or half blood; brother or sister of the whole or half blood or by adoption; children of the actor's brother or sister of the whole or half blood or by adoption; the son or daughter of the actor's aunt or uncle of the whole or half blood or by adoption.

From a legal perspective, if

The reason I went into all of these different states, as well as the three different scenarios, is simple. Pretty much, if Betty has NOT adopted Molly and Polly, then Bob can bang Molly and Polly and it's NOT incest, either legally or morally.

If Betty HAS adopted Molly and Polly, or Betty and Joan were married and then Joan popped out Molly and Polly, then Bob IS committing incest by banging Molly and Polly.

Now, more fun is what acts could Bob do with Molly and Polly? In some states, physical penetration of the vagina is what's against the law, but oral is not. In others, it's both.

And then there's Rhode Island.
No person shall marry his or her sibling, parent, grandparent, child, grandchild, stepparent, grandparents' spouse, spouse's child, spouse's grandchild, sibling's child or parent's sibling.
Consensual incest between people 16 years old or more is not a criminal offense.

I'd hold to this standard generally speaking for it being incest. (plus 1st cousins; big thing is they have the "by blood" criteria)

Although things do get funky on some of the finer points for adopted persons due to power dynamics that may be in play which is where your Rhode Island provisions would likely come into play. For fiction hand-wavium applies to a lot of it, but on the reality side it gets messy for a number of reasons.

That covers most of my permutations and combinations. it's only a nebulous idea at the moment.
Three things:

First I'm Australian and base stories ideas here as much as possible though do not go out of my way to name locals so places are non-descript

Second "Joan" Got pregnant from John's lover. that part of the story is that Joan was going to birth twice. the first time it is the twins. the second time does not eventuate as the relationship between John and his lover does not continue. So he has nothing to do with 'his' children as the agreement was worded such that he was a biological parent only.

Third and this is where Betty's fetish for her brother's cock comes in. she wants her brother's babies because she loves him in her own way. I think I worded it as she knew if she slept with her brother she'd end up letting him knock her up.

So at present Bob meets Joan when she is only a few weeks pregnant as this is the first chapter of the story and part of how everyone is introduced.

As Bob and Joan's semi-platonic relationship grows, Bob introduces Joan to Betty and they hit it off and are married AFTER the birth. However Betty still wants Bob babies but isn't willing to risk it. So Bob will knock up Molly and Polly so that Betty has grand/daughters/nieces that are blood relations to her and in a way gets to have her brothers offspring like part of her has always wanted. I'm holding back on any decisions about adoptions as I want to keep the story more 'open'.

Follows story key points not related to incest

I have backgrounds for Betty and Joan, they run a health retreat in a rural/remote location. Molly and Polly are schooled at home over what used to be called the 'school of the air'.

Bob also lives in isolation in the middle of a state park. he works monitoring the flora and fauna. this is his bread and butter job and how he gets to live where he does. He's also a photographer and this is how Bob and Joan meet via Joan's kid sister. the details of which don't matter here. but Bob has two part time jobs and lives on what we call 'crown' land he has no neighbors or services, he's completely off grid except for a satellite connection for phone and internet. everything else is generated on site or brought in from a few hours away. Basically Bob lives in what we call the bush, on a farm with no stock or crops besides a paddock with a few horses he uses to get around the very large 'property' which is basically a native landscape with no fences or any indication that it's there besides a secluded dirt driveway. Bob only uses e-mail and has a PO Box in town for anything which must be physically delivered

At the moment the daughters are keenly aware not to share personal details such as two mothers etc as this does not go well when they're much younger. The school of the air idea may also be how the twins get to stay with Bob past their summer holiday and go on to bare his children.

right now I'm trying to flesh out the timeline and linkages that intertwine all out cast over the course of the first chapter or two

I need to decide some more about how everyone meets, at least the broad stokes for the establishing chapters.

Generally you only need a few (3 to 6) specific plot points, the rest is often filled with character explorations, as the characters get to know one another, and flesh out their differences. So, a helpful strategy is to carefully law out which issues really get your characters filed, and then stir the pot and see what falls out. (Plus, a few good plot twists or subplots helps flesh out those few basic plot points.)

In most opening scenes, the specific details aren't what's vital, it's everyone having something to discuss. So, a blackout, a flood or even a lockdown (say from a nearby shooting) works wonders, and the character tensions really stand out and gets everyone talking. Parties or dates, not so much, as there are only so many ways to spin those before they get mindlessly repetitive. :(

Legally, it is different from state to state. In most cases, the prohibition include the words related by blood.

I just found out that in Arizona, first cousins can marry IF both are over 65 and one of them can prove that they are infertile.
