Some are out of copyright due to when they were written and the US copyright laws letting them fall into the public domain. Some are on Fine Stories (1) and SciFi Stories (12), but not the one asked about:

I went to SciFiStories.com, performed a Category Search on the tag "Novel-Classic" and it came up with 1125 hits. A similar search on FineStories came up with 93 hits.
There are only three on this site (Fanny Hill, The Count of Monte Cristo, The Teeth of the Tiger) and they are all premier-only. That looks like a bug to me.

It's no bug. In it's early days, Lazeez populated the alternate sites is old, copyright free stories to boost the story count. However, there's a system wide timeout 'retire' feature on any story where the 'original poster' hasn't been active on the site for 5 years. Since there was no original poster, they've pretty much all been placed behind the SOL paywall now.

Not exactly. There are two stories by Benjamin Franklin on the site posted in 2010. He died in 1790 so it is unlikely he has been active on the site since then. I recommend the story about getting a mistress, I even reviewed it. On an April first a few years ago. His other story is about farts, so perhaps you won't appreciate its odor.
No, the original author hasn't been on the site. The original poster (Lazeez) is on every day.

Those three stories were also posted to Finestories back in July 2010 and they are not premier-only there, I'm not even sure there *are* premier-only stories there.
The oldest such story on SciFiStories hit the 5-year mark a few days ago, it does not appear to be premier.

Yes there are, but (so far, anyway) at FS and SFS everyone has premier membership, so effectively there aren't. At least a few stories from SFS have been archived (added to that site's premier-only list), and many from FS.
Ok, on FS's "Authors Starting with A" I see 5 whose stories are premier only (btw, one of them is aubie56).
This is about Alexandre Dumas, his stories are not premier although they were posted in 2010. He died in 1870 so I don't think he's logged on to FS in the last 5 years.
The Count of Monte Cristo is one of the three stories I mentioned as being premier-only on SOL but not on FS.
This has to be a bug on SOL.

Probably not. It may technically be under a live copyright if the original copyright under the US 1906 copyright act had been renewed.
However, in the era in which it was originally published, under US law of the time, the publisher generally owned the copyright, not the author, and the original publisher was liquidated in 1980.
In short, even if it has a technically live copyright, it's an orphan copyright with no legitimate owner who would have legal standing to sue to protect the copyright.
She died in 2005 and was publishing to the end with several works unpublished. In 2008 there was a court battle over the copyrights and manuscripts in her estate. I haven't found who won but I did read her estate is working to reclaim her lapsed copyrights. Her books before 1963 would be the easiest to post until and unless her estate gets them back. I think all her post 1963 copyrights belong to the estate.

She would have had to buy any pre-1976 copyrights back from the publisher.
1976 is when US copyright law was updated to be more in line with the Bern Convention.
Pre-1976 in the US, no copyright existed unless the work was registered with the copyright office and the entity that did the registration owned the copyright.
One of the registration requirements for books was that a copy had to be provided to the US Library of Congress. My understanding is that this required a bound copy, not a manuscript. For this reason the registration was almost always handled by the publisher not the author.
